The Anti-Counterfeit Act requires the recording of intellectual property rights (IPRs) related to imported goods with the Anti-Counterfeit Authority (ACA), a process known as recordation. This function was introduced under the Statute Law (Miscellaneous Amendments) Act of 2018, Section 34B, with regulations published in the Kenya Gazette on July 23, 2021, under Legal Notice No. 118.

Trademark Renewal

Trademarks must be renewed every 10 years to maintain protection. A 6-month grace period allows late renewal with an additional fee.

Patent Renewal

Registered Patents require annual renewals starting from the 3rd year to stay valid. A 6-month grace period is available for late payment with a surcharge.

Industrial Design Renewal

Industrial designs need renewal every 5 years, up to 15 years total. Late renewals can be done within a 6-month period with an extra fee.

ACA Recordation

IP recordation is a requirement of Anti Counterfeit Authority of Kenya. Renewals are required every year with a 30-day grace period.
